1. Agreement to terms
By accessing or using CaseSharp ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using CaseSharp on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, do not use the Service.
2. Service description
CaseSharp is an Australian legal research tool operated by Uptrail Pty Ltd. It provides access to case law, citation networks, treatment classification, AI-powered explanations, and related research utilities. CaseSharp is a research tool, not a law firm, and does not provide legal advice. You must verify all legal information independently before relying on it in legal proceedings, client advice, or academic submissions.
3. Accounts and registration
To access certain features you may need to create an account. You agree to provide accurate information, keep your credentials secure, and notify us promptly if you suspect unauthorised access. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that breach these Terms.
4. Subscription tiers and payment
CaseSharp offers a Free tier and a Pro tier. Paid subscriptions are billed in advance in Australian dollars. You may cancel at any time, and your access will continue until the end of the current billing period. We do not offer refunds for partial billing periods. Prices may change with 30 days notice. Community legal centres may apply for complimentary Pro access.
5. Acceptable use
You may use CaseSharp for lawful legal research purposes. You may not use automated tools to scrape, mirror, or bulk-download content. You may not reverse-engineer, decompile, or attempt to extract the source code of the Service. You may not use the Service to generate misleading, fraudulent, or deceptive legal documents. You are solely responsible for verifying all legal information before relying on it.
6. Intellectual property
CaseSharp, including its design, branding, code, AI models, and proprietary algorithms, is the intellectual property of Uptrail Pty Ltd and its licensors. Your use of the Service does not grant you any ownership rights. Case law and legislation sourced from public records remain in the public domain. Content you create (briefs, packets, saved collections) remains yours. By using the Service, you grant us a limited licence to process your content solely for the purpose of providing and improving the Service.
7. AI-generated content
CaseSharp uses artificial intelligence to generate explanations, summaries, and research assistance. AI-generated content is provided for research convenience only and may contain errors or omissions. It does not constitute legal advice. You must independently verify AI-generated content against primary sources before relying on it. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI output.
8. Data handling and privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information under the Australian Privacy Principles. 9. Limitation of liability
To the maximum extent permitted by law, CaseSharp is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Uptrail Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim, or A$100, whichever is greater. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Uptrail Pty Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law.
11. Termination and suspension
We may suspend or terminate your access to the Service at any time if we reasonably believe you have breached these Terms. You may delete your account at any time by contacting us. On termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy, subject to any legal retention obligations.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email or by a notice on the Service at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Service.
13. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
14. Dispute resolution
If a dispute arises, you agree to first attempt to resolve it informally by contacting us at hello@casesharp.ai. If the dispute is not resolved within 30 days, either party may refer it to mediation administered by the Resolution Institute in Sydney before commencing court proceedings.
15. Entire agreement
These Terms, together with the Privacy Policy and any order forms or subscription agreements, constitute the entire agreement between you and Uptrail Pty Ltd regarding the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
